LAS VEGAS (KTNV) — The Resorts World property under construction on the Las Vegas Strip looks a little too similar to the nearby Wynn Las Vegas and Encore buildings, according to Wynn Resorts representatives.

Therefore, the company has filed a five-count trademark infringement and unfair competition lawsuit against Resorts World Las Vegas LLC.

The 17-page lawsuit was filed in the U.S. District Court of Nevada on Dec. 21 and claims the similar designs have already confused some while possibly misleading consumers that the two could be affiliated with one another.

The complaint continues with Wynn Resorts claiming Resorts World’s design scheme is using Wynn’s registered architectural design consisting of a three-dimensional building with a concave facade, curved bronze glass, coupled with horizontal banding above and between the lines of glass panes.

Additionally, the design of the defendant’s new Resorts World Las Vegas is confusingly similar to that of the plaintiff’s architectural trade dress and copyrighted architectural work. As the new property sits across the street and is likely to cause confusion or deceive the public, according to the lawsuit document.

The five counts of the suit list federal trade dress infringement, unfair competition, federal trademark dilution, state trademark dilution, and copyright infringement.

The Wynn Las Vegas opened in 2005 along with Encore in 2008, and the Resorts World property is currently scheduled to open in 2020.
